Obligations

The obligation on Landlords &  Property owners, both in the Domestic and Commercial sectors, is onerous with current legislation. From 2002 – 2010 legislation which is currently in place and new responsibilities pertaining to Environmental Matters, will impact more than any other time to both existing building stock and New Builds.

Some will do all they can to avoid compliance. They will wait until it is too late and may possibly have to pay a hefty price in fines and which could result in the forced vacation of properties.

The Building Regulations currently in force, together with additional legislation soon to be enforced, will place further burdens on Architects, Surveyors, Consultants, Builders etc.

The days are passing when the simple CORGI safety certificate issued on Gas Appliances or the Electrical Safety Certificate will be satisfactory.

The poorly maintained or controlled Heating and HVAC system is just the tip of the environmental Iceberg. Just like the motor car, buildings will require annual MOT’s together with Building Log Books. The Log Book is already a legal requirement in new commercial properties, it is also a legal requirement when an existing property is modified, such as when a replacement Boiler is fitted. Even the selection of the replacement boiler is no longer a simple task!

Energy and the Environment are set to become as important as Health & Safety Issues, if they haven’t done so already in certain sectors of the construction industry. Recent Bulletins released by CIBSE, gives a very real insight as to what will be expected as the norm in just a few short years. So to plan and invest now will pay dividends in the future.

For a Domestic Property, the evidence of “building performance” could make one property more valuable than a neighbouring property. A new build that has a SAP assessment approval at the planning stage, could contravene Building Regulations should an early alteration effect the original building construction. A commercial Building Log Book could make the difference in letting office space, (energy consumption) or by adding value to a property in a property portfolio, or an intended disposal asset.
